Liability Waiver & Release of Claims

Please read this waiver carefully. By booking a game station rental, private event, or tournament entry with XP Central LLC ("XP Central," "we," "us," or "our"), whether online or in person, you (or, for a minor, their parent/legal guardian) agree to the terms below. This waiver applies to your use of XP Central's business premises (address to be confirmed once our physical location is finalized) and any equipment provided there, including gaming consoles, PCs, controllers, peripherals, furniture, and related property (the "Equipment").
1. Assumption of Risk
You understand that visiting XP Central's premises and using the Equipment involves some inherent risks, including but not limited to: minor injury from movement around the space or equipment (e.g., trips, falls, repetitive strain), risk of photosensitive/seizure reaction to flashing lights or screens for individuals with photosensitive epilepsy, and general risks present at any venue open to the public. You voluntarily assume all such risks.
2. Release of Claims
To the fullest extent permitted by law, you release, discharge, and agree not to sue XP Central LLC, its owners, employees, and agents from any and all claims, liabilities, injuries, losses, or damages arising from your (or your minor's) use of XP Central's premises or Equipment, except where caused by XP Central's gross negligence or intentional misconduct.
3. Responsibility for Equipment
You agree to use all Equipment carefully and only as intended. You (or, for a minor, their parent/legal guardian) are financially responsible for any damage to Equipment caused by misuse, negligence, or intentional acts during your rental, event, or visit, beyond normal wear and tear. Repair or replacement costs will be assessed at fair market value and may be charged to the payment method on file or invoiced directly.
4. Age Requirements & Parental/Guardian Consent
Age requirements for participating in rentals, private events, or tournaments without additional consent or supervision are:
- Ages 13 and up: May accept this waiver themselves and participate without a supervising adult present.
- Ages 10–12: A parent or legal guardian must review and sign/accept this waiver on the minor's behalf before the minor participates. The parent/guardian does not need to be physically present during the session, but remains responsible for the terms of this waiver and for any Equipment damage caused by the minor.
- Ages 5–9: A parent or legal guardian must sign/accept this waiver and be physically present, directly supervising the minor, for the entire duration of the rental, event, or visit.
- Under 5: Must remain under the direct, constant supervision of an accompanying parent/guardian at all times and may not independently operate rental stations or Equipment.
By signing or electronically accepting this waiver on behalf of a minor, the parent/guardian confirms they are the minor's parent or legal guardian and have full authority to accept these terms on the minor's behalf, including the release of claims in Section 2.
5. Private Events & Groups
For private events booked on behalf of a group, the person who books and signs the event booking is responsible for ensuring all attendees (or their parents/guardians, for minors) are aware of and agree to this waiver before participating, and is responsible for any Equipment damage caused by attendees during the event.
6. Tournaments
Tournament participants are additionally subject to our Tournament Rules & Code of Conduct, including eligibility, conduct, and disqualification terms.
7. Photo & Video Release
You acknowledge that XP Central may photograph or record activity in common areas during rentals, events, or tournaments for security and promotional purposes, and grant XP Central permission to use such images in accordance with our Privacy Policy. You may request to opt out of promotional use by contacting us in advance.
8. Acknowledgment
By checking the acceptance box when booking a rental, private event, or tournament entry, you (or the participating minor's parent/guardian) confirm that you have read, understood, and agree to be bound by this Liability Waiver & Release, our Terms of Service, and our Refund & Cancellation Policy.
